The Nachweisgesetz (NachweisG Q038) has obligated employers since August 2022 (EU directive implemented) to document essential working conditions in writing -- on the first day of work. What must be included: Names and addresses of both parties, start and duration of employment, workplace, job description, working hours, holiday entitlement, notice periods, remuneration and its components, reference to collective agreements/works agreements. Penalties for employers: Fine of up to 2,000 euros per violation under Section 4 NachweisG. For applicants: If the employer does not provide documentation, this is a concrete warning sign. Particularly for compensation components (bonuses, commissions), insist on written documentation. Haufe: Verbal promises regarding home office, professional development, or salary increases after probation are difficult to enforce without Nachweisgesetz documentation.
