A crucial difference for the job search. Dismissal by the employer or your own resignation is unilateral — with employer dismissal, you are entitled to notice periods (BGB Section 622, Q035). A termination agreement (Aufhebungsvertrag) is a mutual contract — both sides agree on termination, often with a severance payment. Most important consequence for the job search: with your own termination agreement, the employment agency can impose a blocking period of 12 weeks — no unemployment benefits during this time (BA regulation Q027). With employer dismissal for operational reasons: no blocking period. Before signing a termination agreement: always seek legal advice (employee advice centre, trade union per TVG Q040). Typical severance formula: 0.5 monthly salaries per year of employment — but not legally mandated.
